This was a product liability case brought against four defendants for causing the death of a volunteer firefighter who was filling a fresh air pack at the firehouse to be used by firefighters when entering a smoky building. This was a settlement reached on the eve of a premises liability trial involving a lead paint injury. Before trial, our attorneys made a motion for summary judgment as to liability. The Supreme Court, New York County, granted this motion, holding that the landlord failed to abate a peeling lead paint nuisance, which exposed a young child to serious harm when she ingested paint chips in her apartment. As a result of the exposure, the child suffered physical and emotional injuries and was found to be at high risk for future learning disabilities.
