This was a product liability case brought against four defendants for causing the death of a volunteer firefighter who was filling a fresh air pack at the firehouse to be used by firefighters when entering a smoky building. This was a settlement reached on the eve of a premises liability trial involving a lead paint injury. Before trial, our attorneys made a motion for summary judgment as to liability. The Supreme Court, New York County, granted this motion, holding that the landlord failed to abate a peeling lead paint nuisance, which exposed a young child to serious harm when she ingested paint chips in her apartment. As a result of the exposure, the child suffered physical and emotional injuries and was found to be at high risk for future learning disabilities. This case involved the misdiagnosis of breast cancer in a middle-aged woman who went to her physician with a palpable mass in her breast.
